Why use a Divorce Attorney

Moving, death and divorce are generally considered as the most stressful events any person can suffer. Parties in divorce proceedings must deal with unknown divorce court proceedings, far reaching financial consequences, custody and access to minor children and maintenance issues, all under extreme emotional circumstances.

These circumstances necessitate the appointment of an experienced and knowledgeable divorce attorney that is always available to tend to your needs and support you on all fronts. Baartman & du Plessis Attorneys intend to deliver exactly this service to you.

Most parties opt to engage in divorce mediation, but experience has shown that the individual's attempts to protect his/her interests at all costs, renders most attempts at mediation useless.

Divorce proceedings are initiated by the issue of a summons, in which the plaintiff usually claims for division of assets, custody, access and maintenance of minor children, spousal maintenance, division of interests in pension funds and legal costs. Usually the defendant would defend the action by serving a notice of intention to defend and thereafter a plea on the plaintiff's attorneys. Although most divorces will become settled some will proceed to trail where a judge or magistrate will deliver his/her final judgement.
